Terms and Conditions of Service

Difuzzion Ecosystem — Please read these terms carefully before using the platform or making any purchase.

1. Legal Nature and Platform Philosophy

Difuzzion does not constitute a conventional social network under centralized governance models; rather, it is legally defined as a decentralized multimedia content distribution infrastructure based on peer-to-peer (P2P) technology. This ecosystem is designed to guarantee digital sovereignty and anonymity through an architecture that dispenses with central storage servers, allowing the network to be sustained by its own participants.

Under this paradigm, Difuzzion's role is strictly limited to that of a connection facilitator and manager of metadata (titles, descriptions, and thumbnails), without exercising control over the physical location of the files.

The "Human Infrastructure" Layer and Disclaimer

In a P2P network, information availability depends on file fragmentation and the will of the "seeders" (users who share fragments). This technical architecture acts as a legal shield: by not initiating the transmission, not selecting the receiver, and not modifying the integrity of the fragments, Difuzzion adheres to the "Safe Harbor" regime provided for in the Digital Services Act (DSA). Responsibility for content permanence is transferred from the central entity to the "human infrastructure," placing technical availability outside the platform's operational control.

This decentralized technical base is economically sustained through a system of digital assets that incentivizes participation and network maintenance.

Binding Acceptance

By creating an account on Difuzzion, the user acknowledges having read, understood, and accepted these Terms and Conditions in their entirety. Furthermore, by completing any purchase of Stars or subscription to PRO services, the user explicitly confirms acceptance of these Terms — including the refund, digital delivery, and dispute resolution policies — at the time of each transaction. This acceptance is logged and may be used as evidence in the event of a dispute.

2. The "Stars": Digital Goods Regime and Usage Licenses

To ensure the viability of the ecosystem without compromising privacy or engaging in activities reserved for financial entities, Difuzzion implements "Stars". It is imperative to distinguish these assets from electronic money instruments or bank deposits. Stars are a virtual currency for internal platform use only and must not be confused with legal tender, cryptocurrency, or any instrument with monetary value outside Difuzzion.

Legal Nature

Stars are defined exclusively as digital usage license units within the Difuzzion ecosystem. They possess no monetary value outside the platform, are not transferable between users for external value exchange purposes, and do not constitute legal tender, investment crypto-assets, or electronic wallet balances under regulations such as MiCA or EMD2/3. Stars cannot be exchanged for real money or transferred outside the ecosystem.

Acquisition Mechanics and Earning

  • Direct Acquisition: Purchase using fiat currency through authorized payment gateways (Stripe). The charge will appear on the buyer's bank statement under the descriptor configured in Stripe.
  • Engagement Mechanics: Active participation in the infrastructure through viewing advertisements, completing internal missions, and other organic interaction dynamics.

Product Description and Client Expectations

Stars are digital credits for internal use on the Difuzzion platform. They are not a physical product and no physical shipment is involved. The user acquires a non-exclusive, non-transferable license to use Stars within the available services (tips, subscriptions, PRO Mode, and promotions). By completing a purchase, the user acknowledges that Stars have no value, use, or redeemable character outside the Difuzzion ecosystem and that their only function is to access the platform's internal features.

Redemption Restrictions

The buy-back of Stars by end consumers is strictly prohibited. Once acquired or obtained, Stars can only be consumed within the services provided on the platform.

3. Digital Delivery of Services

All goods and services offered by Difuzzion are exclusively digital. No physical product is shipped or delivered. This section details the nature, timing, and proof of delivery of digital services.

Nature and Timing of Delivery

Upon confirmation of payment, Stars are credited immediately and automatically to the user's account, and the service is considered delivered at that moment. For PRO subscriptions, the activation of features occurs instantly upon successful payment or Stars consumption. The user acknowledges that the delivery of digital content and services takes effect immediately upon payment confirmation and that this constitutes full performance of the service.

Proof of Delivery and Usage Records

Difuzzion maintains detailed records of all transactions and digital deliveries for verification and dispute resolution purposes. These records include, but are not limited to: the date and time of payment confirmation, the date and time Stars were credited to the account, the IP address of the client at the time of purchase, the Stars amount and corresponding features activated, and subsequent usage activity (e.g., Stars spent on tips, subscriptions, or PRO). These records serve as proof of delivery in accordance with digital commerce standards and may be presented as evidence in the event of a payment dispute.

Transaction Records

For each transaction, Difuzzion retains: the Stripe transaction identifier, the amount and currency charged, the date and time of the transaction, the IP address and approximate geolocation, the user's account identifier, a confirmation of successful delivery (Stars credited), and any associated email confirmations or receipts. These records are retained for a minimum period consistent with applicable legal and regulatory requirements.

4. Refund and Cancellation Policy

Difuzzion's refund policy is designed to be clear, fair, and compliant with applicable consumer protection laws, including European Union Directive 2011/83/EU on consumer rights for digital content and Directive 2019/770 on digital content and digital services.

General Principle

As digital content whose execution begins immediately upon payment confirmation and account accreditation, the service is considered consumed upon delivery. Once the service has been initiated or Stars have been used in any capacity (tips, subscriptions, PRO Mode, promotions, or any other in-platform service), the purchase is final and non-refundable. The user expressly acknowledges and accepts that the initiation of the digital service constitutes full performance and that, upon such initiation, the right of withdrawal is forfeited.

EU Right of Withdrawal (14-Day Period)

In compliance with European consumer protection legislation, users residing in the European Union have the right to withdraw from a purchase within 14 calendar days of the transaction, provided that no Stars have been used, consumed, or applied to any service during that period. To exercise this right, the user must contact support@difuzzion.com within the 14-day window, providing the transaction details. The burden of demonstrating that no Stars were consumed rests with the platform, which will verify the user's activity records before processing any withdrawal request. If the conditions are met, a full refund will be issued via the original payment method.

PRO Subscription Cancellation

PRO subscriptions activated through Stars consumption or direct payment are considered fully delivered at the moment of activation. As an immediately delivered digital service, PRO subscription is non-refundable once activated. If the platform introduces recurring billing for PRO services in the future, the cancellation procedure and its effects will be clearly specified in an updated version of these Terms and communicated to the user before any renewal charge.

Exceptional Circumstances

In the event of a verifiable technical failure on the platform's side that prevents the delivery or use of purchased Stars or services, Difuzzion will evaluate the situation and may issue a partial or full refund at its discretion, after reviewing the relevant technical logs and transaction records. Users must report any such issue to support@difuzzion.com within 30 days of the transaction.

Policy Visibility

This refund and cancellation policy is prominently displayed on the platform and is presented to the user during the checkout process. By completing a purchase, the user confirms having read and accepted this policy. This confirmation is registered and stored as part of the transaction record.

5. Monetization Program for Creators and Developers

Difuzzion incentivizes the creation of quality content through a reward system that recognizes merit and performance without establishing a direct financial service exchange relationship between users.

Stars as a Performance Metric

For creators, receiving Stars does not constitute a payment, but rather a performance and popularity indicator. Difuzzion uses this volume as a metric to calculate discretionary economic rewards. As there is no direct transfer of pecuniary value between users, the legal firewall against payment service regulations is reinforced.

Legal Relationship and Discretion

The creator acts as an independent content service provider. Difuzzion reserves the right to grant rewards in USD based on accumulated Stars, always subject to:

  • Anti-Fraud Verification: Evaluation of the legitimacy of interactions.
  • Regulatory Compliance: Verification that the content does not infringe community standards.
  • Settlement Thresholds: Establishment of accumulated minimums and grace periods for operational management.

6. Payment Processing and Regulatory Compliance (Stripe Connect)

Financial integrity and compliance with Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations are pillars of the ecosystem. All payment processing is handled by Stripe, a regulated payment service provider, under its own terms of service.

Stripe Connect Integration and Segregation of Funds

Difuzzion uses Stripe Connect as its exclusive payment provider. Difuzzion does not custody third-party funds at any time, delegating this function to a regulated entity. The processing of payments is governed by Stripe's terms of service and policies, to which the user is also subject when making a transaction.

Operational Risk Layer

By integrating Stripe Connect, Difuzzion transfers the "Know Your Business" (KYB) regulatory burden and tax reporting obligations (such as DAC7 in the EU or 1099-K) directly to the payment processor. This shields the platform from custodial risks and ensures that creator settlements comply with international financial transparency standards without compromising the agility of the P2P network.

Creator Obligations

To access rewards, it is mandatory to complete the identity verification process managed by Stripe. Failure to meet this requirement will result in the impossibility of settling any economic incentive.

Payment Method Validation Period

To protect the integrity of the ecosystem against fraudulent chargebacks, Stars acquired through a new payment method are subject to a 180-calendar-day validation period. During this period, such Stars are classified as "frozen": they may be used for all in-platform services — including tips, subscriptions, PRO Mode, and promotions — but cannot be withdrawn as USD until the validation period concludes. When frozen Stars are transferred to another user via tips or subscriptions, the recipient receives them with the same frozen status and remaining validation timeline. Once the 180-day period elapses without incident, the Stars automatically become fully withdrawable. This mechanism does not affect the usability of Stars within the platform and applies equally to direct purchases and redeemed codes.

Payment Security and Authentication

Difuzzion employs industry-standard security measures for all payment transactions. All card payments are processed with 3D Secure (3DS) authentication when supported by the issuing bank, providing an additional layer of verification that the cardholder has authorized the transaction. Additionally, Address Verification System (AVS) and CVC/CVV checks are performed to validate the payment method. The IP address, billing information, and authentication results are recorded for each transaction and may be used as evidence in the event of a dispute.

Authorization and Evidence Retention

For each payment, Difuzzion and/or Stripe capture and retain the following authorization evidence: 3D Secure authentication result, AVS (address verification) result, CVC/CVV verification result, the IP address from which the purchase was initiated, the email address associated with the account, and the billing name and address provided. This data is maintained in accordance with applicable data protection laws and serves to demonstrate that the cardholder authorized the transaction. In the event of a chargeback or payment dispute, this evidence will be submitted to the card issuer to support the legitimacy of the charge.

Self-Billing (Auto-Invoicing)

By enabling monetization on Difuzzion, you authorize Difuzzion to issue self-billing invoices on your behalf for all creator payments processed through the platform. This self-billing arrangement is necessary to comply with applicable tax and accounting obligations. Difuzzion will generate invoices reflecting the amounts paid to you and will provide copies upon request. You agree not to issue separate invoices for the same transactions covered by this self-billing arrangement.

7. Use of "Stars" in Internal Services and PRO Subscription

The consumption of Stars for premium services represents the purpose of the digital asset and the culmination of the service provided by Difuzzion.

PRO Subscription

PRO Mode offers functional advantages to improve content visibility and management. Its acquisition implies the definitive consumption of Stars or the corresponding direct payment. The activation is immediate and the features become available from the moment of successful payment or Stars consumption.

Irreversibility and Activation Records

Once Stars are consumed to activate PRO Mode, promotions, or "skins," the digital good is considered delivered and the transaction is irreversible. Difuzzion records the exact date and time of each service activation, the features enabled, and the user's account status change. These activation records serve as proof that the subscribed service was effectively delivered and made available to the user.

8. Content Rules and Limitation of Liability

Difuzzion defends freedom of expression but establishes impassable limits to protect network integrity and comply with international legal frameworks.

Strict Prohibitions and Notification System

It is strictly forbidden to distribute content containing:

  • CSAM (Child Sexual Abuse Material): Zero tolerance and immediate reporting to authorities.
  • Terrorism and Extreme Violence: Content that promotes organized hate.
  • Intellectual Property (IP) Infringement: Difuzzion implements a "Notice and Action" mechanism to address reports from rights holders.
  • Malware and Fraud: Any malicious software, spam, or phishing.

Content Usage License

By uploading content, the user retains their intellectual property but grants Difuzzion a limited, non-exclusive, and revocable license to distribute said content through the P2P network and display its metadata in the global catalog.

Technical Liability and Service Disclaimer

Difuzzion is provided "as is" without express or implied warranties of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted service. As a decentralized network, final legal responsibility for content lies with the user who fragments and distributes the original content. The platform does not guarantee the permanent availability of files, which depends exclusively on the participation of network nodes. Notwithstanding the foregoing, nothing in these Terms excludes or limits rights that cannot be waived under mandatory consumer protection laws applicable to the user's jurisdiction.

9. Dispute Resolution and Mediation

Difuzzion is committed to resolving disputes fairly and transparently. Before escalating any claim through external channels, users are encouraged to follow the resolution process described below.

Amicable Resolution

In the event of any dispute, disagreement, or complaint regarding the services, transactions, or these Terms, the user agrees to first contact Difuzzion's support team at support@difuzzion.com before initiating any formal legal action, chargeback, or external complaint. Difuzzion commits to responding to all support requests within a reasonable timeframe and to making good-faith efforts to resolve the issue. Many disputes can be resolved quickly and satisfactorily through direct communication.

Mediation and Alternative Dispute Resolution

If a dispute cannot be resolved through direct communication within 30 calendar days of the initial complaint, either party may propose mediation or another form of alternative dispute resolution (ADR) before resorting to judicial proceedings. Both parties agree to participate in good faith in any such mediation process. The costs of mediation shall be shared equally unless otherwise agreed or required by applicable law.

Consumer Rights

Nothing in these Terms and Conditions restricts, excludes, or modifies any mandatory consumer rights that cannot be waived under the applicable legislation of the user's country of residence, including but not limited to rights under the European Union Consumer Rights Directive 2011/83/EU, Directive 2019/770 on digital content and digital services, and any applicable national consumer protection statutes. Where provisions of these Terms conflict with mandatory consumer rights, the applicable law shall prevail.

Chargebacks and Payment Disputes

If a user initiates a chargeback or payment dispute through their bank or card issuer, Difuzzion will respond by submitting all relevant evidence to the payment processor (Stripe), including but not limited to: proof of delivery (timestamps, IP address, account activity logs), payment authorization records (3D Secure result, AVS/CVC verification), transaction receipts, communication history with the user, and the applicable Terms and refund policy accepted at the time of purchase. Users are strongly encouraged to contact Difuzzion support before filing a chargeback, as unresolved chargebacks may result in account suspension or termination. Difuzzion will respond to all Stripe dispute notifications within the required timeframe and reserves the right to take appropriate action, including account restriction, against users who abuse the chargeback process.

10. Registration, Security, and Contract Termination

Cryptographic Key Management

Registration does not require personal data (email or phone). Keys are generated locally on the device. Although an encrypted copy resides on the server, Difuzzion has no access to the plaintext private key. Losing the password implies the total and irreversible loss of the account and its associated assets.

Effects of Termination

Termination of service, whether by user choice or as a penalty for violating these terms, entails:

  • Irreversible loss of the Stars balance.
  • Deletion of metadata and social data from Difuzzion's servers.
  • Cessation of the metadata display license (though technical fragments may residually persist in the cache of other nodes in the P2P network).

11. Applicable Law, Jurisdiction, and Contact

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Spain and the applicable European Union regulations, including but not limited to the Digital Services Act (DSA), General Data Protection Regulation (GDPR), Consumer Rights Directive 2011/83/EU, and Directive 2019/770 on digital content and digital services.

Competent Courts

Any dispute arising out of or in connection with these Terms that cannot be resolved through the dispute resolution procedures described in Section 9 shall be submitted to the competent courts of Spain. For consumers residing in the European Union, mandatory provisions of the consumer's country of residence that provide a higher level of protection shall apply where required by law.

EU Consumer Compliance

Difuzzion acknowledges and commits to respecting all mandatory consumer protection provisions applicable in the European Union, including the right of withdrawal for digital content under the conditions specified in these Terms, transparency obligations regarding pricing and service delivery, and the right of consumers to seek redress through the courts and consumer protection agencies of their country of residence.
